1. About these Terms

These Website Terms of Use (“Terms”) govern your access to and use of www.intheloopjersey.com and any pages, features or content made available through it (the “Website”).

By accessing or using the Website, you agree to these Terms. If you do not agree to them, please do not use the Website.

If you use the Website on behalf of a business or organisation, you confirm that you are authorised to do so. If you are a business member of In The Loop, your Business Membership Agreement also applies. If there is any conflict between these Terms and the Business Membership Agreement in relation to your membership, the Business Membership Agreement will take precedence.

2. About In The Loop Jersey

In The Loop Jersey is a local discovery platform designed to help people find Jersey businesses, events, activities, offers, experiences, guides and other local information.

Unless we expressly state otherwise, In The Loop is not a booking platform, marketplace, travel agent, tour operator, employment agency or professional adviser. We do not normally sell or supply the goods, services, events or experiences displayed on the Website. These are supplied by independent third parties.

3. Using the Website

You may use the Website for lawful personal use and for reasonable internal business purposes connected with discovering or researching Jersey businesses, services, activities and events.

You are responsible for ensuring that your use of the Website complies with any laws that apply to you. If you access the Website from outside Jersey, you do so on your own initiative and are responsible for compliance with local requirements where relevant.

4. Information on the Website

We aim to provide useful, current and accurate information, but local information can change quickly. Business details, opening hours, prices, availability, event dates and times, offers, menus, facilities, accessibility information and other details may change after publication.

You should therefore check important or time-sensitive information directly with the relevant business, organiser or official source before making plans, travelling, spending money or relying on it.

Editorial content, local guides and articles are provided for general information and inspiration. They are not professional, legal, financial, medical, safety or other specialist advice.

Where content relates to weather, sea conditions, tides, coastal access, walking routes, outdoor activities or other matters that could affect personal safety, you should check current official information and use your own judgement before taking part.

5. Business profiles and directory listings

Some information displayed on the Website is supplied by business members, event organisers or other third parties. A business or organiser is responsible for ensuring that information it supplies to us is accurate, lawful and suitable for publication.

We may edit, format, shorten, crop or otherwise present submitted material so that it fits the Website and In The Loop’s editorial style, without changing its essential meaning.

Inclusion of a business, event, service or organisation on the Website does not, by itself, mean that In The Loop endorses, recommends, certifies or guarantees that third party. Any express partnership, sponsorship, paid feature or recommendation will be identified where appropriate.

6. Events, offers, prices and availability

Events may be postponed, changed or cancelled, and offers may be amended, withdrawn or subject to conditions. Prices, spaces, opening times and availability may also change without notice to us.

Before attending an event or relying on an offer, please check the latest information and any applicable terms directly with the relevant business or organiser. Unless we expressly state otherwise, In The Loop does not control ticket availability, admissions, refunds, cancellations or fulfilment of third-party offers.

7. Your dealings with third parties

Any enquiry, booking, purchase, appointment, contract or other arrangement you make with a business or organisation discovered through the Website is between you and that third party, unless we expressly tell you otherwise.

The third party’s own terms, cancellation policy, privacy information and other conditions may apply. You should review them before entering into a transaction or providing personal information.

Nothing in these Terms affects any rights or remedies you may have against a third-party trader under applicable consumer law.

8. Links to other websites and platforms

The Website may contain links to third-party websites, booking pages, social media accounts or other external services. These links are provided for convenience and discovery.

We do not control third-party websites or services and are not responsible for their content, availability, security, privacy practices or terms. A link does not necessarily mean that we endorse the third party or its website.

9. Content you submit to us

You may be able to submit enquiries, corrections, event information, photographs, business information, suggestions or other material to us. You must only submit content that you are entitled to provide and that is accurate to the best of your knowledge.

You must not submit content that is unlawful, defamatory, misleading, discriminatory, threatening, obscene, infringes intellectual property or privacy rights, contains malicious code, or otherwise creates a material legal or security risk.

Where you submit material specifically for publication or promotion, you grant In The Loop a non-exclusive, royalty-free licence to use, reproduce, format, edit and publish that material through the Website and relevant In The Loop channels for the purpose for which it was supplied. You retain ownership of your content and any rights you already hold in it.

If you are a business member, the rights and obligations relating to Brand Content are also governed by your Business Membership Agreement, which will take precedence if there is any inconsistency with this section.

10. Acceptable use

You must not misuse the Website. In particular, you must not:

  • use the Website for any unlawful, fraudulent or abusive purpose;
  • attempt to gain unauthorised access to the Website, its servers, accounts or connected systems;
  • introduce viruses, malware, harmful code or other material intended to damage or disrupt the Website;
  • scrape, harvest, systematically extract or build a commercial database from Website content without our prior written permission;
  • use automated tools in a way that places an unreasonable load on the Website or interferes with its operation;
  • impersonate another person or misrepresent your connection with a business or organisation; or
  • copy, republish or commercially exploit Website content in a way that infringes our rights or the rights of others.

We may restrict or suspend access where we reasonably believe the Website is being misused or where this is necessary to protect the Website, our users, our members or our legal rights.

11. Intellectual property

Unless otherwise stated, the Website and its original content, branding, layout, graphics, text, database structure and other materials are owned by or licensed to The Loop Collective Limited and are protected by intellectual property laws.

You may view the Website and print or save reasonable extracts for your own personal, non-commercial use. You must not reproduce, republish, sell, license, distribute, modify or commercially exploit a substantial part of the Website without our prior written permission, except where the law permits you to do so.

Business names, logos, photographs, trade marks and other material belonging to third parties remain the property of their respective owners. Their appearance on the Website does not transfer any rights in that material to you.

12. Website availability and security

We aim to keep the Website available and secure, but we cannot guarantee uninterrupted or error-free access. We may suspend, withdraw, change or restrict all or part of the Website for maintenance, security, operational or business reasons.

You are responsible for using appropriate device security, browser updates and other safeguards when accessing the internet. We do not guarantee that the Website will always be free from bugs, vulnerabilities or harmful material, although we take reasonable steps to operate it securely.

13. Our responsibility to you

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, or affects any mandatory rights you have under applicable law.

Subject to that, In The Loop is responsible for its own operation of the Website, but we do not control independent businesses, event organisers or other third parties. We are not responsible for the acts or omissions of those third parties, the quality or suitability of their goods or services, or a third party’s failure to honour a booking, offer, event or other commitment.

We are not responsible for loss caused by reliance on information that you knew, or reasonably should have known, required confirmation from the relevant business, organiser or official source, particularly where the information is time-sensitive or safety-related.

If you use the Website for business purposes, then, to the fullest extent permitted by law, we will not be liable for loss of profit, revenue, business, contracts, anticipated savings, goodwill or data, or for indirect or consequential loss arising from your use of or inability to use the Website.

14. Privacy and cookies

Our collection and use of personal data is explained in our Privacy Notice. Our use of cookies and similar technologies is explained in our Cookie Notice.

We may update the Website and these Terms from time to time to reflect changes in our services, functionality, legal requirements or business practices.

The latest version of these Terms will be published on the Website and will show the date on which it took effect. You should check this page occasionally so that you are aware of the terms that apply when you use the Website.

16. Governing law and jurisdiction

These Terms and any non-contractual obligations arising out of or in connection with them are governed by Jersey law.

The courts of Jersey will have jurisdiction in relation to disputes arising from these Terms or use of the Website, subject to any mandatory rights a consumer may have under applicable law that cannot lawfully be excluded or restricted.
